Welcome sign!

Hon'ble Justice Mr. Kapadia has now been elevated as Chief Justice of India.

A positive factor about this posting is he believes in Integrity.

"Newly appointed Chief Justice of India (CJI), Justice S H Kapadia, has said the only asset he possesses is integrity and hopes to fulfil the Constitutional obligations to achieve the goal of "inclusive growth."

"I come from a poor family. I started my career as a class IV employee and the only asset I possess is integrity", Justice Kapadia said in a letter written to former Supreme Court judge V R Krishna Iyer on May 3.

AGE NO BAR FOR CORRUPTING THE MORALE OF THE SOCIETY

Can anyone imagine that a person who is of 87 years old and been into politics (including holding the post of chief minister of a state) for decades had been caught doing immoral activities leading to his resignation? The poor chap does not know how to 'steal properly' :) With his experience in corruption, he should have been more cautious! Being a Governor of the state, he has got so many immunity and resources at his command which he has failed to utilise properly. This shows not only his carelessness but also his braveness that he was very well aware of what he is doing and knew that no action can be taken against him. (By the time, his trial commences, he will die his natural death with the plans to re-born in India as a politician again and complete the deeds he has left behind due to age factor, if any)

As we are blessed with the habit of forgetting things, let us experience more of this episodes again and again!

His family tree, ie., his sons/daughters (including illegitimate ones) and their kins should be traced and watched by the society as well as severe actions like disallowing them into politics and participating in public activities should be banned for them. This will serve as a punishment for this old and seasoned criminal.

So many raids, what's the outcome?

The Income Tax (I-T) department has raided 12 Housing Development and Infrastructure (HDIL) premises, reports CNBC-TV18 quoting sources. The raided premises include residences of two HDIL directors. HDIL’s shares dropped 3.85% on the Bombay Stock Exchange on Thursday to Rs308.65. The benchmark 30-stock Sensex rose 0.21% to close at 16,216.86 points. HDIL is listed on both the BSE and the National Stock Exchange (NSE).
The search began at 8:30am at the firm’s corporate offices in Mumbai. A senior IT official confirmed the development but declined to disclose the findings of the search. “The search and survey pertain to tax evasion issues related to the real estate and infrastructure sector,” he said, adding that the search would continue on Friday. He declined to be identified.
Hariprakash Pandey, deputy general manager (finance) of HDIL also confirmed that the searches had been conducted. “It is a normal income tax search on the corporate offices of HDIL and the officials are checking the books of accounts of HDIL.
HDIL had earlier raised Rs1,698 crore through a qualified institutional placement or QIP, in which shares are placed privately with potential institutional buyers such as banks. HDIL cut its debt to Rs2,900 crore at the end of June from Rs4,143.31 crore at the end of March.
Sources said the department has recovered unaccounted cash of Rs 1.54 crore so far.
HDIL has been claiming excess expenses and undermining profits, it has been alleged. Over 100 I-T department officials were involved in the raids today, sources said.
More than Rs 300 crore of unaccounted income has so far been unearthed by the tax department in 2009 and in the latest case it almost seems like a thriller of sorts. At around 8:30 am with synchronised watches, more than 100 IT department officials began their raid on 12 of HDIL’s premises. Two premises were residential premises of directors and 10 business premises.
What were the charges? According to sources, the IT department alleges that HDIL has suppressed its profits by claiming excess expenditure. So, in short in a nutshell, the IT department has alleged tax evasion against HDIL. These raids, which began in the morning, were mostly based around the Bandra area and we also understand that there was another small player – Seaside Developers – based in Kandivli, who is also under the scanner of the IT department as far as the entire investigation is concerned.
So, as of now what we understand from sources is that Rs 1.5 crore of unaccounted cash has been unearthed during the raids on HDILs premises that were conducted this morning. This is the amount that has been unearthed so far. It is a developing story and we also understand that this would be a two-day raid and by tomorrow evening we will get a clearer picture.

SEIZE PROPERTIES OF CORRUPT OFFICIALS, SAYS CHIEF JUSTICE OF INDIA

New Delhi, Sep 12 (PTI) Chief Justice of India K G Balakrishnan today favoured statutory provision for seizure of illegal properties and assets of government officials convicted in corruption cases. He also wanted specialised teams of lawyers to ensure that they will progressively develop expertise in prosecuting corruption-related cases.
"If a public official amasses wealth at the cost of public, then the state is justified in seizing such assets," Balakrishnan said at a national seminar on ''Fighting Crimes related to Corruption''. "One prominent suggestion is the inclusion of a statutory remedy that will enable confiscation of properties belonging to persons who are convicted of offences under the Prevention of Corruption Act (PCA)", the Chief Justice said.
The CJI said procedural delays like granting sanction and difficulty in marshalling large number of witnesses were the major hurdles in achieving meaningful convictions when the anti-corruption agencies was already finding it difficult to grapple with 9,000 pending cases due to shortage of designated courts. "It is necessary (that) there should be a speedy manner of granting sanction.
The prosecution becomes ineffective if the sanction is granted after 6-7 years," he said. Balakrishnan expressed concern that CBI relies on large number of witnesses in the corruption cases instead of coming out with solid witnesses which unnecessary prolongs the trial of the case for 3 to 4 years.
"Instead of having 8 to 10 witnesses, emphasis should be on having one solid witness to prove the case," he said. .


It is really a wonderful and needy solution. Until and unless there is fear of losing everything, the corrupt officials will not mend their ways.

Towards this, the Government should seek all the data from their servants regarding their movable/immovable properties. Even if one purchases any goods worth more than Rs. 25,000/-, they should seek prior permission. {If one wants the Govt job, then they must obey the rules. Otherwise, there are plenty of over-qualified and honest persons available to do the job}. Slight violation of the rule should also not be tolerated. Besides administrative action, there must be heavy levy of penalty. For example, if one is got for holding a property worth Rs. 5,00,000/-, the penalty must be Rs. 25,00,000/- (5 times). Similarly, the Anonymous complaints cell must be formed under 'Right to Information' to gather information on the corrupt officials. Till the investigation is completed, the official under scanner can be named as "X" or "Y", and once the investigation is over, it must be published for information to all.

"EARN WHILE YOU LEARN" :- The students who are studying in 10+1 or in the Ist year of college can be trained in their field of interest after their regular study hours at the school/college premises. For example, the commerce students of 10+1 or B.Com., Ist year students can be trained by a chartered accountant firm/CA. Likewise, the science stream students can be trained by the firms by providing the students with practical knowledge. At corporation/Govt Schools, if the vacant place is allotted to the companies under "BOT" (Build, Own and Transfer) wherein the suitable companies which are selected by the Govt under 'TRANSPARENT SELECTION" build a workshop/class room wherein the students selected through 'merit and economic condition alone' can undergo practical training (on job-oriented) after their school hours. As the 'Apprentice' training imparted by Railways usually have the students of whom majority are the children of their own employees, it is not possible to a poor student to gain entry into those institutions. If you seek the past records of the 'PSUs' and 'Railways', you'll be astonished to know that those jobs are enjoyed by majority of them by 'Generations'. If a person gains such employment, not only he has job security but his generation too will have the assurance of job security. To bring all the economically poor students at par with others, it is essential to get them trained in job-oriented course at least 3 hours per day during their 10+1 or during their college years.

Introduction

The readers are cautioned about my english language writing style. Am not proficient in English as I have studied in Tamil Medium till my 10th Standard.

Everyone is affected by 'corruption'. Throughtout my life (still) I was affected by this corrupt society. I feel we do not have 'fundamental rights'. Everything depends on corruption/bribery.

This blog is being written by me to share my experience as well as to fight against this social-evil (I have an inner feeling that nothing will happen). Just I am venting-out my feelings. This has happened with me and I strongly feel that still someone must be undergoing the same trauma which I underwent.

The first page was written in Tamil, but, unable to continue due to process-flow.

1. During my 9th Standard, I was in NCC (National Cadet Corps). To gain entry into this, I had to request the NCC master of that School several times. I do not know why he was reluctant to include my name. (I do not want to quote my religion or the school's, but, now I presume it may be the reason). Later, when my father was transferred to Chennai I have obtained Transfer Certificate from the School. Since I was in NCC for 1 year I went to this NCC Master's house (which was several miles away)and requested him to give NCC Certificate (or transfer certificate of NCC so as to continue NCC in my next school). He simply refused saying that 'for one year I cannot give any certificate'. I still remember the master's name after so many years because this person has spoiled my career. Since Childhood I was dreaming to either get into military service or police service. This corrupt teacher has spoiled my career. Here, I would like to quote a 'good Headmaster'. After completing my 10th standard in Tamil Medium (I just obtained 51% of marks), I wished to continue my Higher Secondary in English Medium. But, I have got 'History Group' which was the only Tamil Medium group available at that school. When I expressed my intention to change my group into 'english medium', even my father was against the idea. I made several visit to my Headmaster's office to get my group changed. Then my H.M. asked me to come alongwith my father. (My father reluctantly came!). My H.M. said only one sentence 'I will watch your Ist Mid-term marks in English, if you do not pass it, then I'll revert you into Tamil Medium'. I accepted. [As the mid-term test contained only one lesson (still I remember that lesson, it was an essay on 'Cricket'), I could easily pass that exam with 83% marks and I was the class-first in English]. If that H.M. (Mr. A.V. Subramanian) has not allowed me to change my group from 'History' to 'Vocational Group' (i.e., Accountancy, Commerce), my life could have got into worse stage. Whenever I am using my pen to scribe my signatures I remember my HM. THIS IS WHAT A GOOD TEACHER CAN DO TO A STUDENT'S LIFE.

தமிழில் அறிமுகம்

"லஞ்சம் வாங்குவதும் குற்றம், கொடுப்பதும் குற்றம்" - இந்த வார்த்தைகள் ஒவ்வொரு அரசாங்க அலுவலகங்களிலும் எழுதப்பட்டுள்ளன. ஆனால் நடைமுறையில் நடப்பது என்ன ? "கொஞ்சம் வாங்குவதும், கொஞ்சம் கொடுப்பதும் குற்றம்".

ஒவ்வொருவருக்கும் ஒரு ஆற்றாமை இருக்கும். பல வருடங்களாக எனது ஆற்றாமைகளை பகிர்ந்து கொள்ள காத்திருந்து இப்போது ஒரு வடிகால் கிட்டியது போல இந்த வலைத்தளத்தில் எனது எண்ணங்களை வெளியிடுகிறேன்.
இதில் வெளியிடப்போகும் தகவல்கள் உண்மை சம்பவங்கள். இதனால் யாரும் பாதிக்கப்பட்டதாக கருத வாய்ப்பு இல்லாதவண்ணம் எழுத முயற்சித்து உள்ளேன். ஒவ்வொரு எழுத்தாக ஆங்கிலத்தில் டைப் செய்வது கடினமாக உள்ளதால் இனி ஆங்கிலத்தில் எழுத உள்ளேன்.
